Terms of Service

1. Eligibility

You must have an active Shopify store and be at least 18 years old, or the age of majority where you live. You must also follow the Shopify Terms of Service and the Shopify API License and Terms of Use.

2. What the App does

KepviaSEO helps you improve your store’s search visibility and content. Depending on your plan, the App can:

• Import and audit your products, collections, blog posts and pages, and rank issues by impact.
• Write SEO titles, meta descriptions, product descriptions, titles, image ALT text and image file names with AI.
• Compress and resize images, keep the originals, and restore them on request.
• Run site checks and page speed scans, find broken links, manage 301 redirects, and publish llms.txt, an HTML sitemap page and structured data (JSON-LD).
• Edit many products at once in a bulk editor.
• Show analytics and run A/B tests on product titles and descriptions.
• Keep a full history of every change, with one-click undo, and an audit log.

We may add, change or remove features over time. If we remove a major feature from a paid plan, we will tell you in advance.

3. Your account and store access

The App works through the permissions you approve in Shopify. You are responsible for your Shopify account, for who on your staff can use the App, and for any activity under your store.

If your storefront is password protected, you can give the App your storefront password so scans can open your store. We store it encrypted and use it only for scans.

4. Changes the App makes to your store

• You stay in control. By default, AI only writes drafts. Nothing reaches your store until you click Apply, unless you turn on Safe auto-fix or Full auto-fix in Settings or choose to apply results in a bulk optimization.
• Undo. Before the App changes an item, it saves the previous version. You can restore changes from History, subject to what Shopify allows at that time.
• Your review. You are responsible for reviewing AI-written text, file names and other changes before you apply them, and for making sure your store content is accurate and lawful.
• Some changes need your action in Shopify. For example, the home page title and meta description must be pasted in Online Store > Preferences, and theme app embeds must be switched on in the theme editor.
• Image file names. Renaming an image changes its URL. The App asks for your approval for each rename.

5. AI-generated content

AI can make mistakes. The App checks AI output for length, format and unsupported claims, and it builds text only from your store data and the facts you add. We still cannot guarantee that AI output is accurate, complete or suitable for your purposes. You are responsible for the content you publish on your store.

Between you and us, you own the content the App writes for your store, to the extent the law allows.

6. No guarantee of results

SEO, page speed and A/B test results depend on many factors outside our control, including search engine algorithms, your theme, your competition and your traffic. Scores, scans, analytics and A/B test results are tools to help you decide. We do not guarantee any ranking, traffic, conversion or revenue result.

7. Plans, billing and trials

• Plans. The App offers a Free plan and paid plans with different features and monthly limits (such as products, AI suggestions, image optimizations and scans). The current plans and prices are shown in the App under Plan & billing and on our Shopify App Store listing.
• Billing through Shopify. All charges are billed by Shopify on your Shopify invoice, in US dollars, monthly or yearly depending on the interval you choose. Taxes may apply.
• Free trial. Paid plans may include a free trial. If you do not cancel before the trial ends, the subscription starts and Shopify bills you.
• Usage charges. Where a plan includes usage charges, they are capped at the amount you approve in Shopify.
• Changes. You can upgrade, downgrade or cancel at any time from Plan & billing. Shopify applies plan changes and any proration according to its billing rules.
• Price changes. We will give you at least 30 days’ notice of a price increase for your plan.
• Limits. When you reach a monthly limit, the related feature pauses until the next billing period or until you upgrade. Products beyond your plan’s limit can still be viewed and audited, but not optimized with AI.

8. Refunds

Charges are billed through Shopify and are generally non-refundable, including for partial billing periods. If you believe you were charged in error, contact us at [email protected] within 30 days of the charge, and we will review your request in good faith. Approved refunds are issued through Shopify.

9. Acceptable use

You agree not to:

• Use the App to publish content that is illegal, misleading, infringing or harmful.
• Use the App on a store you are not authorized to manage.
• Try to break, overload, reverse engineer or get around the limits or security of the App.
• Resell, sublicense or share the App with others outside your business.
• Use the App in a way that breaks Shopify’s terms or the terms of search engines.

We may suspend access if you break these rules or if your use puts the App, other merchants or Shopify at risk.

10. Third-party services

The App relies on Shopify and other services, such as AI providers, Google PageSpeed Insights, hosting and storage providers. Their availability and terms are outside our control. We are not responsible for changes or outages in these services, or for how Shopify or search engines treat your store.

11. Intellectual property

We own the App, including its software, design, text and trademarks. We give you a limited, non-exclusive, non-transferable license to use the App for your store while these Terms are in effect. You keep all rights to your store data and content.

If you send us feedback or suggestions, we may use them without any obligation to you.

12. Privacy and data

Our Privacy Policy explains how we collect, use and delete data. When you turn on the Kepvia tracking app embed, you are responsible for telling your store visitors about it in your own privacy policy and for getting any consent the law requires.

13. Availability and support

We work to keep the App available and reliable, but we do not promise it will be uninterrupted or error-free. We may pause the App for maintenance or updates. You can contact support at [email protected].

14. Disclaimer of warranties

The App is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

15. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or rankings, arising from your use of the App.

Our total liability for any claim related to the App is limited to the amount you paid us for the App in the 12 months before the claim arose, or USD 100 if you used only the Free plan.

Nothing in these Terms limits liability that cannot be limited by law.

16. Indemnity

You agree to defend and hold us harmless from claims arising from your store content, your use of the App in breach of these Terms, or your breach of any law or third-party rights.

17. Termination

You can stop using the App at any time by uninstalling it from Shopify. Uninstalling cancels your subscription through Shopify. We may suspend or end your access if you break these Terms, if required by law, or if we discontinue the App with reasonable notice.

After uninstall, we stop all processing and delete your store’s data as described in our Privacy Policy. Changes the App already applied to your store stay in your store.

18. Changes to these Terms

We may update these Terms. If we make significant changes, we will notify you in the App or by email before they take effect. If you keep using the App after that, you accept the updated Terms.

19. Governing law

These Terms are governed by the laws of TODO_GOVERNING_LAW, without regard to its conflict of laws rules. Disputes will be handled by TODO_JURISDICTION, unless the law where you live gives you the right to bring a claim elsewhere.

20. General

If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a right, we have not waived it. You may not transfer these Terms without our consent. We may transfer them as part of a merger or sale of our business. These Terms and the Privacy Policy are the entire agreement between you and us about the App.
